Assemblywoman Parra Secures Passage Of Crime Victims Legislation

SACRAMENTO – Assemblywoman Nicole M. Parra (D-Hanford) announced the passage of AB 2272 from the Senate Public Safety Committee by a vote of 4-1. AB 2272 would extend the amount of prior notice individuals applying for a writ of habeas corpus must give to district attorneys in the county where an offense was prosecuted.

“Anytime we are faced with the potential of a criminal getting back on our streets, we need to be prepared,” said Assemblywoman Parra. “It is important that district attorneys are granted this extended notice so they have the time to fully review any application for a writ of habeas corpus. We cannot allow for even the slightest error or oversight to happen in these types of cases.”

Currently, when inmates wish to appeal a decision of the parole board, they appeal to a judge within the same county for a new hearing. A 24 hour hold is put on the appeal to notify the district attorney for the county in which the prisoner is being housed. Often, the district attorney in the housing county does not know the details of many of these cases. AB 2272 would require a person applying for a writ of habeas corpus because of the decision by the Board of Parole Hearings to give 72 hours notice of the application to the district attorney of the county in which the offense was prosecuted.

AB 2272, which is supported by Crime Victims United of California, now moves to the Senate Floor.
